Under the State Strategy for 2026–2030, improvements are envisaged to the mechanisms for confiscating criminal assets and returning them from abroad. These measures are set out in the State Strategy to Counter the Financing of Criminal Activity and the Legalization of Criminal Proceeds for 2026–2030, approved by Cabinet of Ministers resolution No. 653 of September 29, 2026.
Legislative changes and implementation timeline
As part of these plans, amendments are scheduled to be drafted to several key regulatory acts. These include the Criminal Code and the Criminal Procedure Code, as well as the Code of Offenses on issues of digital evidence, freezing, seizure and confiscation of virtual assets.
- The amendments must provide for a mechanism to assess criminal property at equivalent value
- Separately, the development of a mechanism for confiscating property without a court conviction is envisaged
The confiscation mechanism without a conviction will apply only in specific situations where criminal prosecution cannot be completed. Such cases include, for example, the death of the accused, the accused being wanted, or the absence of an identified owner of the property.
The strategy also emphasizes the need to observe constitutional guarantees of property rights and judicial protection.
