The procedure for antimonopoly regulation in the country has been changed; in particular, the rules for controlling company mergers, the creation of joint ventures and the provision of state aid have been clarified. The relevant resolution was signed by Chairman of the Cabinet of Ministers Adylbek Kasymaliev.
Stronger control over economic concentrations and transactions
Under the new rules, the Antimonopoly Service will conduct reviews in cases where companies' actions may affect competition in the market. This applies to:Mergers, acquisitions, reorganizations and the creation of joint venturesAcquisition of shares or stakes in companies' charter capital}, {
Control over state aid
An important innovation is the expansion of the service's powers to assess state support. The Antimonopoly Service will now review draft decisions on the allocation of state aid. The agency will be able to assess how the provision of benefits, preferences or subsidies may affect competition in a particular sector of the economy if the total amount of financial assistance exceeds the established minimum threshold.
Additional functions of the service
In addition, companies can now submit their own internal documents on compliance with competition law requirements to the antimonopoly authority for review. The service will issue opinions on whether these documents comply with the established requirements.
These changes are aimed at generally strengthening market oversight in Kyrgyzstan.
