In Jumgal district of the Naryn region, a dispute continues over the Aurdin market in the village of Chaek. Local authorities had previously attempted to challenge ownership of the market, but the courts have issued a final ruling on the matter.
The court dispute and conflicting documents
During a discussion of the issue at a meeting of the ayil okmotu on June 30, 2020, discrepancies were found in legal documents. Participants in the meeting, including representatives of the district state administration, the cadastre, architecture, the ROVD, the State Environmental and Technical Inspection and deputies of the local kenesh, discussed the fact that two different state acts exist for a single plot.
The discussion also raised issues of financial regulation: it was proposed not to charge traders rent until the dispute is resolved. In addition, local residents demanded that action be taken against persons who, they said, have been collecting rent from traders since 2000.
The parties' positions on legal status
The parties to the dispute presented different versions of the market's legal status. For example, Rustam Alymkulov, who then served as head of the ayil okmotu, asserted that the market is municipal. It was also noted that Aurdin's state act is not registered anywhere, and that the registration service lists a different plot belonging to the company of only 14.5 square meters, not 31.5 square meters.
On the other hand, Aksana Arstanbekova, daughter of Arstan Abdyldaev, founder of Aurdin LLC, insisted on the legality of the actions, citing a letter from the district cadastre assigning 31.5 square meters to the company, as well as the existence of an akim's order and a purchase and sale agreement with the Jumgal consumer society.
